How Much Does It Cost to File for Divorce in Riverside County?

Once your divorce paperwork is filed out, you will head to the clerk’s office for filing. There you will pay a $450 filing fee, although the court may waive the fee in the event of proven financial hardship.

How to File for Divorce in Riverside County

To file for divorce in Riverside County, you will need to complete the following forms:

  • Petition (Form FL-100)
  • Summons (Form FL-110)
  • Certificate of Counsel (Local Form)
  • Declaration Under Uniform Child Custody Jurisdiction Enforcement Act (if you have minor children) (Form FL-105)

Next, you will file an original and two copies of each form with the clerk’s office at the courthouse. After, you will need to hire or appoint someone to serve your spouse the divorce papers.

The Basic Steps for Getting a California Divorce

To become eligible for a divorce in California, you must meet the residency requirements. These are as follows:

  • You or your spouse must have lived within state lines for at least 6 months prior to filing
  • You or your spouse must have lived within the county that you wish to file for at least 3 months

As California is a no-fault divorce state, you do not need to provide a ground or a reason for divorce other than it is irretrievably broken.

Once this step is completed, you will need to submit the appropriate paperwork and serve your spouse the court documents. The other spouse has 30 days to respond either agreeing to the terms or disagreeing. Once the divorce paperwork has been filed, you must adhere to a 60-day waiting period.

During the waiting period, the court may issue a judgement and termination. This would address topics such as property and asset division and a custody agreement. If you cannot reach a divorce agreement after six months, you will need to go to court to settle your differences.
