Domestic Partnership & California Law

According to California family law, people who are not married but live together as cohabitants may be eligible to register as "domestic partners." The state of California defines a domestic partnership as, "two adults who have chosen to share one another's lives in an intimate and committed relationship of mutual caring." Domestic partners act as married couples, but do not have a marital relationship. Therefore, when two people decide to register as domestic partners, their legal partnership does not make them married. However, the rights, responsibilities and benefits they will now be privileged to are very similar to those of married couples.

In order for people to establish a domestic partnership in Riverside County or anywhere else in the state of California, they will need to file a Declaration of Domestic Partnership with the Secretary of State. Additionally, they must meet certain eligibility requirements before they file their Declarations.

Some of these requirements include:

  • sharing the same home or residence
  • not being married or having another domestic partnership
  • not having blood relation to one another
  • being 18 years of age or older
  • both partners consenting to the partnership
